I have been unable to obtain an answer from the Mint or the US Treasury. Its Crazy they don't have a way to contact them by e-mail to ask such questions. I have to assume that eventho the 2009 overstrike was struck on a genuine (Legal Tender) US Mint issued eagle, the removal of the original mint mark and replacing it with a dc mint mark (as well as the proofing) probably negates this coin as a legal tender coin. Since this is the same as defacing US Currency, I'd be interested to know how the treasury department views this coin. If anyone finds out, I'd like to know. It does server a useful purpose of filling the 2009 hole in the Proof Eagle set....Thanks...Bill

I believe, under a special Federal Reserve Act, you need a permit, or otherwise, it is ILLEGAL, ONE HUNDRED PERCENT. I may be wrong, as it may not be allowed at all. As far as I know, the only thing that you are actually able to deface is a coin, when turning it into the souvenir coins you get from the wind up machines.
