Technically yes it is. Because your edited photo required the original in order for you to make your derivation you would be guilty of infringement. People get sued for infringement and have to pay a royalty if they lose. If they were using it for personal profit, it may also be a criminal offense. Perhaps best to ask nicely for removal of copyright violation or payment of a modest fee to cover a one-time distribution license.
