Yes, the statue is usually damage to public or private property. At least it is in my state statues.

Of course graffiti is illegal,because if you dont have permission to spray words on a wall or a house and a police sees you then of course it is illegal.

In almost all cases it is considered a crime. Defacing someones property or public property is usually a misdemeanor unless a lot of damage is done as a result of the graffiti.
