That is a old law from the 1800s. Its illegal because horse thiefs would put ice cream bars in their back pockets, then they would go up to a horse and would let them smell the sweet ice cream and the horse would follow them into a alley or out of town, then the thief could just jump on the horse and ride away.
That's how people stole horses from the Kentucky Derby. Because if the horse followed you home it wasnt technically stealing.

Whether its illegal or not, I doubt anyone will prosecute such a stupid law. I would be more worried about sitting down and getting wet, sticky ice cream all over the back of my pants. Besides how are you going to enjoy eatting it before it melts that far from your mouth.
