Yes it is illegal under Georgia Law to pass a MARTA bus on a one lane road, or on a double solid lined road. On a multi-laned road, however, it is okay to pass a MARTA bus.
Unfortunately, I just got a ticket for doing it this morning, which is how I know this.

"This pass remains the property of the bus company." If you can prove you're legally entitled to use the pass - you can reclaim it at the office of the bus company, so long as you can prove your identity.
