Section 4-401 of the Uniform Commercial Code provides that it is perfectly legal to write a post dated check, though many banks tend to lie and say that it is illegal so they can get out of admitting they made a mistake by accepting it, at the same time banks, car companies, finance companys, etc require postdated checks as security on loans so this is more proof that they are blatant liars when they tell you its illegal, but i would say its not worth trusting the company with waiting to cash the check until the date it says, in most cases people will cash them before the date on the check and unless you tell the bank in advance that you wrote a post dated check by giving them the check number, who you wrote it to and what date it should be paid there is no recourse to recover any overdraft fees.

it always has been and always will be that the banks make the laws to benefit them so its as unfair as possible for the average joe, and this is why we need to end the fed!!!
