Post date a check means that you write a check on a day and mention the date of a future day in the check.
i.e., let's say I give you a check today 22 January 2011 and write the check date as 15 February 2011. This is post dating a check. This means that you cannot cash the check until 15th February 2011 and until then the check is of no value.
Post Dated checks are perfectly legal as long as the person who receives the check does not cash it before its due date.
Please note: If you send a post dated check in to ,say your mortgage company!! They are NOT going to look at the date! They will send it on to the bank, If it is early..... it will be sent back as non sufficient. This can cause a lot of issues. None of this is answering the question as to what is the law!! I WILL be learning this today and will answer here again.
Post-dated checks are generally legal and can be written in Texas. However, banks are not obligated to honor post-dated checks and may cash them before the specified date. It is recommended to communicate with the recipient of the check to ensure it is not cashed before the intended date.
Yes, post-dated checks are legal in Georgia. However, banks have the discretion to cash them before the date written on the check unless you have given them specific instructions not to do so. An example of an ex post facto law in the Philippines is one that retroactively criminalizes behavior that was not considered a crime when it occurred. For instance, passing a law that makes a certain action illegal and then punishing individuals who committed that action before the law was enacted would be considered an ex post facto law.
Yes, switchblades are illegal to own, buy, sell, or carry in Texas. Texas law prohibits the possession of switchblades with a few exceptions for certain individuals, such as law enforcement officers.
Background checks are a common practice in the hospitality industry, including for bar staff, to ensure employees do not have a criminal record that could pose a risk to customers or the business. While it may not be a specific law to work in a bar, many establishments conduct background checks as part of their hiring process to maintain safety and security.
Employers are not required by federal law to conduct background checks on employees. However, some state or local laws may require background checks for specific industries or job positions. Employers may choose to conduct background checks to ensure a safe and secure work environment.
Are post-dated checks issuing allowed by the State law in Greece or it is forbidden? Tks for the answer. Massimo
The law preventing collection agencies from collecting post dated checks is the Fair Debt Collection Practices Act. You can learn more about this at the Wikipedia.
This depends upon laws in your particular jurisdiction, but in most cases, there is no such thing as a "post-dated check" in the eyes of the law. When you write the check, you should be capable of honoring it immediately.
Most people believe that banks cannot honor a check prior to the date written on a check. (These people are, to put it simply, wrong. Under US law, a bank may honor a post-dated check unless the account holder has specifically put them on notice of that particular check, generally by a procedure similar to that required for putting a stop payment on a check.) The reason people post-date checks, then, is to keep them from being honored prior to a particular date. You should HIGH LIGHT THE DATE! This is to make people LOOK at the date! In today's time, the world has forgotten the basics, do NOT count on that check being held until that date.
Well, its illegal. Most District Attorneys offices wont prosecute it though. But if you do it enough, they can and will prosecute you. Its called Theft by Check.
No its against the law.

Yes, but it needs to be in the name of the person on the check and since it is post dated there could be a reason. Usually, a person writes a check like that because the money is not in the account yet.
Texas Law Review was created in 1922.
