The DHR can ask for a drug test, but you do not have to comply without a court order. If you refuse to comply, they will most likely go before a judge and get an order. Tests are usually requested when allegations are made or there is a history of drug abuse.

If your daughters dad has visitation rights but no legal or physical custody can I refuse visitation in CA?

If Dad has court-ordered visitation then you have to follow it or you are in violation of a court order (and there are consequences for that). If there's a valid reason you don't want Dad to have visitation, then you can go to court and request that the court modify the visitation order. But be aware that the court will not do that without a very valid reason.

If my ex takes our daughter does he have a right to keep her if he decides not to return her she is 4 and we are not married but his name is on the birth certificate?

If you're in the US and there is no legal custody order in place, then yes (because he as the same rights to the child as you do). Of course you can then go to court and obtain a custody order and he'll be ordered to return the child, but without that court order there's nothing you can do.
