Some Durable Powers of Attorney grant broad powers including the power to make medical decisions. You would need to review the POA document. If you think an elderly you know is being taken advantage of you should bring it to the attention of the Probate and Family Court. If the court appoints a legal guardian, the POA is extinguished. If your concerns are very serious you should consult with an attorney.
A real estate broker has only one fiduciary duty and that is to his or her client, also known as the principal. Real estate agents act as the broker's representatives -- always. In every part of a real estate transaction, he or she is the broker's agent. Therefore, despite the fact that the agent may have procured the client, he or she did so as the broker's representative. Therefore, the only principal for whom a broker works is the client -- the home buyer or seller.
If the home loan can be proven to be to the benefit of the principal then there should be no problem. If it is to the benefit of the agent alone then the matter has to be investigated.
It varies by location and is ALWAYS negotiable between the Seller/Principal and the agent representing him/her.
Only if the elderly agrees to it. Otherwise it is a form of abuse and/or kidnapping as it is against their will and not required by law. Most likely without consent or a court order, the nursing home will NOT take them on as a patient because it tends to be a legal liability.
Contact a legal organization for the elderly for help. I live in a nursing home and my daughter takes care of my finances.
A nursing home may need an attorney for legal advice on issues such as compliance with regulations, patient care disputes, employee matters, licensing requirements, and potential legal claims or liabilities. An attorney can help ensure the nursing home is operating within the law and protect its interests in legal matters.
I don't believe that a nursing home has the legal authority to file property liens, altho I suppose they could get a judgment from court and then try to enforce it. Medicare will pay for nursing home care for, at most, a few weeks. After that, the bill becomes your responsibility unless you qualify for Medicaid. In the latter event, the State will file a property lien and/or estate claim to recover the cost of care.

No. A nursing home (extended care facility) is a medical facility. Social services may be obtained in a nursing home - but a nursing home is not a social service agency, per se.
