Yes, single parents, regardless of divorced or never been married, are free to live with whoever they choose as long as that person is not bad for their child. This is what happens after people with children divorce - they find new partners and moves on.

I am married but separated from my husband we have a 1 year old child and I have custody with no order What are your legal rights until you get a custody order you live in MN?

You now only have physical custody, but both you and your husband have equal custody rights to the child. That means he has a right to have physical custody too, and will not get into any trouble if he physically takes the child into his care. If you are afraid he might take the child, you will need to obtain a temporary custody order, signed by a judge, to make sure you become the custodial parent. That said, depending on your husband, the longer you have physical custody of the child, the more difficult it will be for your husband to obtain legal custody should you divorce.

When would a judge in Arkansas give the non married father custody of a baby?

In Arkansas custody is assigned to an unmarried mother unless there is reason to give custody to another person. A father may get custody if he is determined to be a fit parent and he is able to show the court that it's in the child's best interest to remove the child from the mother's custody and award custody to him. He would need to show some degree of unfitness on the mother's part that would compel the court to make the change. You can read more about child custody in Arkansas at the related link. Ex-boyfriend lied to a judge and the judge gave him temporary custody?

I assume that the "ex-boyfriend" is also the father of the child. If you believe that he lied to gain custody, you can file a motion/petition for a custody re-hearing and be prepared to demonstrate that he lied, and that you are a 'fit' mother to have custody of the child.

Can child's father gain custody if he doesn't like mothers new boyfriend?

In the US, no, you can't gain custody merely because you don't like your ex's new boyfriend/girlfriend. However if that boyfriend/girlfriend is unfit/ presents a danger to the child, that's a totally different situation.
