Yes, an individual can own stalactites and stalagmites. But they have to be taken from nature in a legal manner, and vended and acquired through legal means. Naturally there may by (are) shady dealers in geological specimens who will shortcut this process. If you purchase items from them, you support their activity.
in the USA yes but if they were taken from a protected cave system (state of federal) you are in big trouble - so know who you bought them from. To my knowledge, its legal if the cave is on private property. contact the national geographic society or a good mineral and rockhound website for more specifics.
In the UK, if the cave has been declared a "Site of Special Scientific Interest" wilful damage, destruction or removal of speleothems except perhaps for strictly limited, bona-fide scientific research, is illegal irrespective of land ownership.
In all cases collection for its own sake, let alone for sale, is regarded as vandalism by cavers generally; wherever the cave is located. The only exception would be the removal for preservation or analysis of formations from cave passages being destroyed by quarrying or civil-engineering: and SSSI status can prevent that too.
