No, that's like asking if it's illegal to steal a car as long as you don't give it to a chop-shop. Downloading copyrighted material is infringing on the copyright itself, the MPAA and RIAA would have a field day in court if they get you (they will sometimes pretend do be a valid download source, log your I.P., contact your internet Service Provider and pursue legal action). It's a rare occurrence statistically but it still happens... It's best to look for something under the Creative Commons instead.
