First, you cannot obtain a search warrant. Police and prosecutors can, but only if they have enough evidence that there has been a crime, and that searching might solve it. Search warrants must be issued by judges.

If you are smoking marijuana on a porch and a cop driving by smells it can he search you and your friends andor your house?

yes it gives him/her probable cause to search the persons outside, but not inside without a warrant. however, he may keep the person's detained until a judge signs a search warrant, which could take 30min. to a few hours. also, pray its not a k-9 unit. if the dog smells drugs, its an automatic ok to search, in most states.

If someone says there are drugs in a house can police search?

In the United States, we are protected by the Constitution from such searches. Police may only search if: 1) they ask and get permission, or 2) they have a warrant. A warrant must be issued by a judge who makes the decision on whether or not there is sufficient evidence to indicate a likely crime. Most drugs are not illegal. Most houses are full of all sorts of drugs. You are probably referring to contraband drugs.

Can you be searched in your home for drugs?

It is possible that if the police were there at the time the drugs were sold then an exigent circumstance exception could apply. However that is not normally the case. Most often the information about drug sales are presented to a magistrate and a warrant is obtained. The police may then do a controlled buy to confirm drugs are in the house immediately prior to the warrant service.

What are ways police search for drugs in a house?

The police can search a house on suspicion of the presence of drugs is a couple conditions are met. Firstly, if they have gone before a judge and been granted a warrant, then the house can be searched in accordance with the warrant. Second, if the police can demonstrate probable cause to suspect that there is illegal activity occurring in the house (i.e. the possession of drugs) then it can be searched but that search can be challenged on 4th Amendment grounds.

No, not unless the error was found and corrected by the issuing judge or magistrate BEFORE the warrant was executed. If the warrant was served at the wrong address, anything found and seized could be excluded as evidence.

Can the police arrest and charge you if they find Drugs during a stolen goods warrant search?

The rule is that; During the execution of a valid search warrant, if evidence of a crime is discovered that is un-related to that for which the warrant was issued, the police may take action for the newly disclosed offense. In this case, they had a valid warrant to search your premises for stolen goods, and during that search, they discovered contraband drugs. Yes, they can arrest upon making that discovery, even though that was not the reason they were there for originally. The warrant gave them them lawful permission to be there in the pefromance of their duties, they are not required to turn a blind eye to things other than what is specified in the warrant.

What is solid evidence in Florida to search home for drugs?

The Fourth Amendment guarantees against searches conducted without probable cause. Probable cause, in this context, would be information that would cause a reasonable person to believe there are unlawful drugs in the home. This information can come from many sources--informants who may have been in the home and seen the drugs, officers who have watched drugs being delivered to or sold out of the home, tips received from neighbors, etc. Although a home may be searched on probable cause alone, in most cases officers will apply for a search warrant before searching a home. Issuance of the search warrant is dependent on the judge signing the warrant agreeing that the information supplied by the police is sufficient to support probable cause. When the judge does agree and signs the warrant, he is saying he believes the police have "solid evidence" to search the home.
