STILL ONE OF THE GREATES BENEFITS AVAILABLE: Life insurance with a named beneficiary is paid outside the estate, directly to that beneficiary. It is not subject to any other claims by anyone involving the decedent. (It is also not taxed). Unfortunately, some people name themselves or their estate (which is the same) as the beneficiary. Then it simply becomes another asset of the estate to be taxed, and distributed after handling the claims against the estate.

If the life insurance policy had listed as the beneficiary the spouse only then it is not considered part of the estate and is not subject to claims. If the beneficiary is the estate then it is subject to claims. The only problem with the spouse being the only beneficiary is if she was a party to the claims personally then perhaps she and the proceeds from the life insurance could be subject to these claims.

Probably not. And why should you? Once you cash it in, it isn't life insurance anymore. The source of funds makes no difference once they are converted. You owe people for things you promised to pay them for. I'll bet there wasn't any agreement about which money of yours was to be used exclusively to pay it....pay your bills using whatever you have to to pay them. In bankrtuptcy ALL your debts and ALL your assets must be reported. All are given priorities and some may be exempt from being used and some exempt from being discharged, as determined by the court/laws. Generally, life insurance assets are exempt from being seized.

In your case, no, the proceeds will not be included in the estate of the decedent. Since you were the named beneficiary the proceeds pass directly to you.
