In the US, it is legal to overtake and pass a bicycle. However, as with all road obstacles, the passing must be done safely. As well, the bicyclist also has "rules of the road" responsibilities, including not to impede traffic and to use all precautions to bike safely... including to move as far right and off the road as possible so that traffic has the right of way.
* Important - Bicycles must travel in the same direction as traffic which is on the right lane (right shoulder for bikes) in the US, and not ride "against" traffic. City traffic and bicyclists often have more risks to each other, because there is no road shoulder.
