Debts of the spouse are considered to have benefited both of them. He can be held responsible for the debts.
No.
My husband has termial cancer and I was wondering when he passes will I be responible for any credit card debts he has and any of his medical bills? We live in the state of Ohio.
Only if the couple resided in a community property state at the time of death.
Illinois is not a community property state, therefore a spouse who is not a joint account holder is not responsible for the credit card debt of the other spouse.
I live in Illinois and when my spouse passed away 7/31/08 I was not responsible. I just called them showed them the death certificate and had them pick it up.
depending on who was using the card, that's who's fault it would be... I'm going to assume since it was your spouse's credit card, that your spouse is then responsible for it.
The spouse is not responsible and should not have this on her credit. But the estate of the deceased will still be responsible for the debt.
The estate of the credit card holder. If the surviving spouse was an approved user, or co-signee they would also be responsible.
Half and half.
No, the spouse is not responsible. However it does come out there assets left behind.
If the two of you are married, I believe you are responsible.
the person who opened the account. (wife, husband). for example. if the wife had registered the credit card, she would be responsible for anything that has to do with the credit card. unless, the husband damaged or took over the credit card account. who ever's name the account is under is held responsible. If one spouse refuses or will not pay debt they are not forced to, however they will check if the other spouse is willing to pay. either way one will have to pay or take hold of the credit card. Then someone will be forced to or both may have to come up with an even amount of money.
