The relevant law is the 1996 Defense of Marriage Act("DOMA") which prohibits federal recognition of some marriages. Eligibilty for Stafford Loans and Pell Grants is based upon individual income, spousal income and (until a certain age) parental income. If you have no legal spouse for purposes of federal law, then his income is not included when calculating eligibility, regardless of whether he lives with you.
