∙ 12y agoIf you and your same-sex spouse regularly eat meals together and you live together, then he is treated as a miscellaneous household member and his income is counted towards your eligibility. If your same-sex spouse does not live with you, then he could be a millionaire and you could still get food stamps, since the United States Department of Agriculture which administers the SNAP (food stamp) program does not consider him to be your spouse or responsible for feeding you.
