The court will address visitation and child support when it considers the petition for custody. If there are no orders in place and the parents are married they both have parental rights including a right of visitation. If unmarried, the "other parent" need to have parental rights established which they will be during the aforementioned proceeding.

Visitations should be allowed prior to the proceeding unless there is an issue of child endangerment that will be reviewed by the court. The court will not look favorably upon a parent who simply refuses to allow the other parent visitations with the child.

If noncustodial parent alter the court visitation order do you still have to allow visitation?

It the non custodial parent alters the court ordered visitation, the other parent does not have to allow the visitation, unless it was altered in court. If it was not altered in court, the parent can file for contempt of court.

Yes, visitation can be petitioned at the court. The father have to establish paternity first by a DNA test.

If i pay child support by law can you see your child?

Paying child support does not automatically give someone the right to visitation. Assuming the other parent has custody and is not willing to voluntarily allow visitation, you'd have to petition for court-order visitation.

Is it illegal to not allow the children to see the other parent if they do not pay child support?

If there is a court order for visitation or custody it is illegal to not follow the court order. Child support, custody and visitation are 3 separate issues in court. Paying child support or not is not a reason to take away the child's right to see his/hers parent.

What if the custodial parent does not allow the child to see the non-custodial parent even though the court said she can - does the non-custodial parents still have to pay support?

Child support and visitation rights are two entirely different issues. The terms of visitation should have been determined before divorce proceedings and finalized when the divorce decree was awarded. The court generally prefers the parents reach an amicable agreement for reasonable visitation by the non-custodial parent. If specified days/times have been ordered by the court the custodial parent must allow visitation or risk being in contempt of a court order.

How does a father enforce visitation in joint custody when the mother won't allow him to see the child in the state of Florida?

What do you need to do if you have sole custody and want to move out of state?

If you have sole legal and physical custody then you inform the other parent that you are moving and make whatever arrangements are necessary. If custody is still an issue and the other parent does not agree with the move, you may need to petition the court in a custody hearing.Added: The question fails to disclose if the non-custodial parent has visitation rights. If the other parent has rights of visitation, you may not deprive that parent of their right to see the child by imposing unusual, harsh, or onerous travel requirements to deprive that parent of their right to see the child. Then there is also the possibility that the court will not allow the the child to be removed from the jurisdiction of the court.Of course, if the non-custodial parent states that they are okay with the move, the entire problem may be moot.

Can a custodial parent prevent the noncustodial parent from talking to their children on the phone?

Maybe, if the absent parent does not share custody in any manner and there is not a visitation order in place, a custodial parent can take whatever action he or she chooses in regards to a minor child. However, courts do not look favorably upon any parent who does not allow the other parent to have a relationship with his or her minor child/children unless there is substantiated reasons (child abuse, endangerment, etc.) for the action. A parent who is being denied access to his or her child/children can file suit for visitation and/or custodial rights if they so choose.

Arkansas laws on primary custodial parent does there have to be a custodial oarent?

Arkansas has no true shared custody, and therefore the judge always indicates which parent has prime custody. Even if the parents agree to shared custody, the non-prime parent is only given the right to the standard visitation unless the parties work out and submit in writing a more lenient visitation schedule. I k now this to be true, because my son and his ex got a divorce and asked for shared custody. The final decree gave his primary custody and her the every-two- weeks, etc., she would have gotten in any case. They shared because he wanted to. My granddaughter thought it would work for her, too, but her ex didn't stick to the plan once he got prime custody and she only sees her son when the papers allow her to.

Can one parent allow medical information to be shared without consent of the other parent?

Do ex step parents have visitation rights in ND?

No. There is no provision in North Dakota state laws to allow visitation with an ex-step-parent. That person would have no legal standing.
