Not directly. The spouse that receives the inheritance can determine what is done with that inheritance. There is no automatic right for the other spouse to receive any of it.

Is a husband entitled to inheritance even though not named in a will when it was predetermined they would keep their estates separate and the children would get everything?

Typically a spouse is entitled to a portion of the deceased's inheritance if no other intentions are stated. However, if there is a will in place that declares that the children are sole inheritors, the spouse would not receive inheritance.

In North Carolina is a spouse entitled to a portion of the other spouse's inheritance?

In general, no. First, North Carolina is not a community property state. Second, in general, inheritance remains separate property, even in community property states, unless the inheriting spouse commingles the assets (mixes the inheritance in with community assets; for example, deposits the money into a joint checking account).

Is a wife entitled to her husbands inheritance during marriage?

No. A spouse has no right to any interest in their husband's or wife's inheritance. In most States in the event of the death of either husband or wife their estate automatically passes to the surviving spouse. There are other states that allow other immediate family other than the surviving spouse to lay claim on assets if the deceased did not have a legal will. If the husband or wife has a legal will that designates the inheritance or other property or possessions to other family members/people, the surviving spouse may contest the will but that is usually not very successful in most cases. Regarding marital assets and divorce: most states consider an inheritance separate property and not part of the marital assets as long as the recipient keeps it separate.

Is a spouse entitled to inheritance if they abandon the other spouse?

Yes. Marriage is a legal status that brings all kinds of legal rights and obligations. Two people who are married remain married until they end their marriage by a divorce decree. Therefore, even if the spouses have not been living together for years, they would each have statutory rights in the other's estate. You need to consult with an attorney who specializes in probate in your state if your spouse has die and you are wondering about your rights of inheritance. If you are married, have been "abandoned" and you're wondering about what would happen to your property if you died then you should consult with a divorce attorney about ending the marriage legally.

What is inheritance tax?

Inheritance Tax is a tax which can arise where a beneficiary receives an inheritance as a result of someone dying. The beneficiary is responsible for paying the tax. An inheritance can be taken under a will or intestacy - or in some other way such as, for example, where an asset in the joint names of the deceased and another person is taken, on the death of the deceased, by that other person as survivor.

What if a spouse dies and you may be a beneficiary to their 401k but you divorced 10 years ago are you still eligble?

IF you are still the beneficiary on file for your ex-spouse then you are legally entitled to that money. If there was an updated beneficiary that lists other people as the beneficiary then you are not. On caveat is if you are listed as the beneficiary and the ex-spouse has a will in place that leaves the account to someone else, then you are not entitled.

Is a separated spouse entitled to proceeds resulting from the sale of real estate by the other spouse in WV?

It depends upon who owns the property. If both names are on the title then each is legally entitled to 50% of the net proceeds. If the property is in the name of the "other spouse" alone then they have no legal obligation to share the proceeds. Of course, that might change if the couple was in the process of a divorce and the divorce had been filed.
