Nope. The Company who developed it, Interplay, went out of business. They have yet to sell the series' rights to anyone else. Really. I know, it's awful. I looooove that series a ton.

An Interplay representative confirmed for GameSpot that the company owns the Dark Alliance name, and can continue to make fantasy role-playing games under that banner so long as they don't use the Dungeons & Dragons license, which includes the Forgotten Realms world and the Baldur's Gate name.
The company has recently reinitiated its in-house game development studio, and is hiring game developers. [2]

( they just go out of business, and that's not the real issue at hand one of the main reason that they metion that you failed to mention is that the owner of the Dungeon & Dragons Corp. decided not the sponser them for the 3rd installment of the game. That's why they decided not to make a 3rd edition of the Baldur's Gate game.)

No, because in the second game there are different characters from the first game's characters, and at the end of the first Baldur's Gate, they get taken away.

There is a cheat code for this but, it doesn't work you have to beat the game then play the challenge on the main menu "Gaunlet" with drizzt at lvl 16 and 15 min. to complete it. To unlock him once you have completed it then you can play extreme mode with drizzt just import him from you save directory and there you go the number bad to the bones character.
