In most Berne Convention countries, copyright obtains when a work is first created. If you were to make a poster incorporating the text "Up It" in some artistic way, the entire work would be protected under a copyright, the rights to which you would own. Using your own work in that way would not be a copyright violation.

Words may also be protected as trademarks or service marks, where a particular combination of words is used to brand a particular product or service (or groups of products or services). Assuming no one has used or registered the trademark "Up It" to refer to pens, you could produce a line of "Up It" brand pens, and register for the trademark "Up It" referring to your particular line of pens.
