Technically, No. Water boarding is considered unethical by some, but no previsions in any laws I can find prohibit water boarding.

In the most public case the water boarding of two people, know to be very bad men, saved the life of thousands in California. How is the inconvenience of two men even comparable to the thousands that lived because of it. Remember these were known to be VERY bad men. I believe it IS illegal. A sheriff weas convicted in Texas during the early 1980s for doing this. Also, if it is legal, why don't police ' waterboard ' prisons or suspects?
Legally, it is unambiguously clear that waterboarding is torture, both under international law and under U.S. law. The United States prosecuted Japanese soldiers for torture for waterboarding American soldiers during World War II.
Having gone through the experience in a training exercise, I can honestly say that water-boarding is NOT torture. Uncomfortable yes, torture no.

From descriptions in the media, it does sound like torture, but I haven't actually observed it.
One definition of torture is defined as permanently damaging a person for the purpose of obtaining information. Under this definition, no.
The second possibility is that torture must have a prolonged phyisical or mental abusive element. Again water boarding does not qualify.
It is not a good experience. It was used on very few occassions and was successful in saving thousands of lives in Los Angeles.
