The rational basis test
The rational basis test.
The government applies the Equal Protection Clause by using a framework of scrutiny levels to draw reasonable distinctions among different groups. These levels—strict scrutiny, intermediate scrutiny, and rational basis—help determine whether a law or policy is constitutional. For instance, laws affecting fundamental rights or suspect classifications like race undergo strict scrutiny, requiring a compelling government interest. Conversely, regulations concerning non-suspect classifications may only need to demonstrate a rational basis to be deemed constitutional.
Order
The Miranda decision does not prevent a suspect from answering any question. In order for any statement to be considered admissible in court, the police have to warn the suspect of his constitutional rights consistent with the ruling in the Miranda case. Once the suspect has been warned of his constitutional rights -- the right to remain silent and not answer any questions, the right to have a lawyer present, the right to not answer any further questions even if certain questions have been answered, the right to have a lawyer present even if one cannot afford it, and that any statement the suspect makes can be used against him later on in court -- the suspect is then free to make whatever statement he wants.
an officer is justified in using force in order to arrest a resisting suspect?
Kingdom, Phylum, Class, Order, Family, Genus, and Species
i always have thought that American robins have these as classifications: Kingdon; animalia Phylum; chordata class; aves order; passeriformes family; turdidae genus; turdus
KINGDOM: Animalia PHYLLUM: Chordata CLASS: Reptilia ORDER: Squamata
One issue!? I suspect there were many issues that needed to be worked out. If you get a room full of delegates with competing agendas together in order to draft a document to define a country it would take a miracle to pull off.
Because there are different ways to classify things. You need to have it all organized in order to make any sense.
There is an order of animal classifications, starting with Domain, and then going to Phylum, Class, Order, Family, Genus, and then species.
Phylum: Chordata Class: Mammalia Order: Perissodactyla Family: Equidae Species: Equus caballus
