This is dependent on whether it is voluntary or due to denial of access, as happens in 60% of the cases.
In the United States, a fit mother will almost always win custody over a grandmother. There would need to be some other considerations for a grandmother to win.
damn good!
Until recently custody decisions were based almost solely on the?
Yes. For more info. see GRANTING CUSTODY Did the parent keep in contact with the children? Here's the incarcerated prisoners manual http://www.prisonerswithchildren.org/pubs/ipm/toc.htm
A bit of almost a few years
You are going to probably have to hire a lawyer that deals with child custody cases. He will help you find a way to make it look as though you are the more stable parent or gaurdian. This is gonna get messy though. My sister fought this forever with her ex.
Not usually unless he is proven to have abused the children. He may or may not get joint custody it just depends, and almost always father or mother have visitation rights.
For example, a Stanford study of 1,000 divorced couples selected at random found that divorcing mothers were awarded sole custody four times as often as divorcing fathers in contested custody cases. A study of all divorce-custody decrees in Arlington County, Virginia over an 18 month period found that no father was given sole or even joint custody unless the mother agreed to it. According to Frank Bishop, the former director of the Virginia Division of Child Support Enforcement, almost 95% of custody cases in Virginia were won by mothers.
What do I do when my sons father hasn't been there for my sons in over 11 years and now wants custody?
United StatesState laws vary widely in the United States but in almost every state the biological parent has sole rights to custody of the child. If a custodial parent dies the surviving natural parent will normally be granted custody of the child unless they have already been deemed an unfit parent. If the grandparents want custody they would need to prove in court that the surviving biological parent was unfit to take proper care of the children. The grandparents have a better chance of success if they can prove the surviving parent was not involved in the child's life and that they had a parent-child relationship with the child, took the child to normal activities such as doctors appointments or school and they cared for the child over extended periods. That is why the US returned a little boy to his father in Cuba when his mother died while bringing him to America. This was done even though the parents were divorced and the grandparents fought to keep him in the US
If a father is able and available to care for his own son due to the fact that he is a seasonal worker, can the mother petitioned the courts for the father to continue paying child support, does daycare supersede the bonding between a father and a son? She legally cannot keep you from your children. But they do it all the time. Contact the courts and apply for a legal aid which will represent you for free. But first contact your human services where you pay your child support. They can't really do much, but sometimes a call to the mother from them explaining that she is in contempt of court will scare her RIGHT. Trust me , it happened with my husband and his ex because I would't provide their daughter with my insurance. Child support and visitation are two different things.
