You would have to check with your local laws about livestock and whether they are allowed where you live. Also, horses when living on only grass with no hay or anything else, need at least 2 acres. If the horse doesn't have this much room and doesn't seem to be being fed hay to make up for the lack of grass, then watch for the horse to show signs of starvation. If you start to see his bones more vividly than you used to, call your local animal protection agency, or the police who can likely direct you towards someone who will take care of it.
i dont no if that is legal , but call the RSPCA or something like them EMEDIATLY ! a horse should not be kept in a garden because there wont be enough room for it to do what horses do - galloping around , bucking , having fun and generally running around like foals sometimes. there wont be enough grass to feed and mantain the horses nutrition level and to feed it , unless the horse is getting loads of hay plus 2-3 feeds a day depending on the breed of horse. the horse will also of eaten all the grass in 1-2 weeks depending on the size of the garden. basically get that horse out of there !! call the RSPCA , they will deal with this.
