There are at least 5 states where a debt collector is prohibited from speaking to a spouse: Iowa, South Carolina, Massacgysetts, Pennsylvania, and Connecticut. With Iowa there is an exception, however. If the debt collector is initiating contact then they can't speak with them but if the spouse is initiating contact they can.

There are only nine CP states and they are: California Idaho Louisiana Nevada New Mexico Texas Wisconsin (this state is not considered a "true CP state" in regards to the way the laws for marital debt and/or assets are determined.)
Massachusetts is a non recourse debt state. Other non recourse debt states are Kentucky, Louisiana, Maine, Maryland, Michigan, Montana, and Mississippi.
There must have been a judgment obtained and then they can act on the judgment and attach wages.

It will most likely be turned over to a collection agency. Then it will be reported to the credit bureaus which will make it difficult for you to get loans in the future.
There is no set amount that determines if a lawsuit will be inacted. One of the major factors is the collectibility of the debt. If the consumer/debtor has a job, non-exempt assests and lives in a state where the lender can recover legal expenses then a lawsuit is very likely. Several states allow arbitration as another of option of debt settlement/collection.
