Yes you have to have 10 hearts but you also have to catch the rock lobster to marry him in on of the gull islands. I think that is after you complete Collins rainbow.

There are more requirements to get married besides having a lot of hearts. You have to get all five of his events. House Visit Lunch Date Request Event House Visit Again Confession Toby will request you bring him a Rock Lobster. You can catch it fishing off Gull Island during Spring or Winter.

Try to get there before 10:00am. To get the Rock Lobster you must fish off of Gull Island. But you can only catch one during Winter and Spring. To raise Toby's heart levels give him a gift he likes once per day. He likes Broiled Fish.
