A court summons means you do have to attend court so you need to write down the chain of events as accurately as you can. A good idea is to place an advertisement in your local paper, or a daily paper of the area the accident happened, asking for any witnesses to contact you. The fact your insurance company refuses to settle the claim indicates they are not placing blame on you. Saying this, I do not know whether your car was warranted and registered at the time of the accident. Contact your Insurance agent and ask why they did not pay out and take it from there.
