Until you have a decree of separate maintenance or a final decree of divorce from a court, you must file as married filing jointly or married filing separately. If you did not live with your spouse during the final 6 months of the tax year at all, you may be eligible to file as head of household if you also meet the other requirements for head of household.

If you are married to someone from Argentina must you claim married on your income taxes?

Yes, if you earned any income in the USA. You must either file married filing joint or married filing separtely. Since you are legally married these are your only choice with the IRS tax code. Unless you are separated for the last 6 months of the year and plan not to reconcile. Then you may file Head of household if you have a minor dependent living with you for at least 6 months.

When calculating child support does the father add the mothers income to his then pay the mother 26percent to her?

No. If you are not married you pay child support to the custodial guardian, in this case the mother (?), and they take a 26% (?) out of your income to pay for the child. She is also already spending a % of her income. Since you are not married you do not share a income.
