Putting the ethical and moral issues aside, the reality is a minor cannot take custody of any person's child, regardless of the circumstances. Even an adult cannot legally take custody of a child without following the proper procedures. Who receives custody of an infant in such a situation is decided by a judge not the mother. It is preferable that said infant be placed with a family member who qualifies under DSS regulations. If that is not possible the infant will be made a ward of the state and placed in a foster home.
