Putting the ethical and moral issues aside, the reality is a minor cannot take custody of any person's child, regardless of the circumstances. Even an adult cannot legally take custody of a child without following the proper procedures. Who receives custody of an infant in such a situation is decided by a judge not the mother. It is preferable that said infant be placed with a family member who qualifies under DSS regulations. If that is not possible the infant will be made a ward of the state and placed in a foster home. I Don't think that they should!! How exactly would they be supporting the child that they have taken in and what would they do with the expense's of the child that the took in like the the daycare, diapers, milk and clothes, shoes and ther need that the baby would have.

Can an 18 year old mother sue the 16 year old father of her baby for child support if he won't help with the baby?

No he is a minor just like that baby will be. That boys mother has all control of him. If he got arrested he cant go to jail because he is a minor. Its his choice not to take care of it. The person who gave this answer is an idiot and I'm surprised they can even work a computer. 16 year olds go to jail all the time and yes if they have a child they can be made to pay child support.
