That's a job for the state. Call your local police department (or whatever agency is "in charge" where you are) and get an officer to come out and take a police report. The district attorney will then decide whether or not to proceed with the case based on the police report and your evidence. (You may be able to have some "influence" on the decision, but maybe not.) If the state proceeds (and the amount of money and the circumstances will dertermine that, usually), you're good to go. If not, then you take what you have and proceed to civil court to sue. Let the state run with it from the beginning. If the amount is "low" and the D.A. declines to go ahead, you may be able to go to small claims court to win an judgement, and that's if you don't want to hire an attorney and file a civil suit.
