No, a person selling a toy (assumably after legal purchase) for more than the toy retails is not an illegal action.
If there is a short supply of items combined with a high demand for those items, the price of the items will go up. Since retailers cannot normally charge more than a certain percentage over MSRP for toys, diligent individuals will step in and buy as many as possible (further lowering supply) and resell them at a profit.
