Cruel and unusual. Defining what that means has been a matter of opinion since it was written 230+ years ago.
The United States Constitution protects an individual against punishments which are deemed to be "cruel and unusual." This protection is included in the 8th Amendment to the Constitution and has been interpreted to include prohibition against torture and certain forms of capital punishment.

The 5th amendment
There is no amendment in the US Constitution which protects you against ACCUSATIONS. However, you are granted the right against 'self incrimination' by the 5th Amendment.
Self incrimination and illegal search and seizure are two of the things.
It enstills the laws that our government must abide by. Our constitution states our individual rights that the government is not allowed to come between.
