Common law and case law is derived from previous decisions. There is no law based simply on common sense.
No. The justices are appointed by the president for life, death, or until they retire. They are suppose to be objective and neutral so they can base their decisions on the interpretation of the constitution and previous cases.
First give a brief statement of the facts. Then identify the legal issues the case presents. The relate the law which applies tot he issues - statutory, if any, but more importantly case law, from published appellate decisions of courts in the jurisdiction. If you want the case being briefed to be decided in accordance with previous decisions, argue why this should be the result. If you want a different result than previous decisions would seem to dictate, argue why the case at hand is distinguishable from the earlier decisions.
Wisdom is an acquired knowledge of lessons learned from many different situations and it is the highest level of maturity. If you can make logical decisions based on previous experience that would be wise.
