The Posse Comitatus Act and DoD Policy prohibit the Armed Forces of the United States from performing law enforcement activities on U.S. soil. The U.S. Army and Air Force are prohibited specifically by the Act itself; the Navy and Marines are prohibited by Department of Defense policy and regulations.Only the U.S. Coast Guard is exempt; it primary function is maritime law enforcement. On occasion when Navy resources are being used to hunt down and interdict drug smugglers, an actual Coast Guard officer is aboard a Navy vessel involved in the operation to make any arrests.Note that the Act also does not apply to the National and Air Guard while in a militia capacity under State Governor control.
