Hopefully this employer uncovered the employee's falsification during the I-9 process. The employer should involve an attorney to ensure their legal rights are protected, as failure to properly complete an I-9 subjects the business to penalties. Additionally, citizenship is a protected class under discrimination law (obviously illegal immigrants are not protected) and if the employee is otherwise legally able to work in the United States any action against them may result in a claim - especially if the hiring process itself was flawed.
