Fruits can be vegetables.

We usually think of fruits as sweet, but they are defined as any product of a tree or other plant that contains seeds and can be eaten as food. That's the important part - the seeds are inside it. If the seeds are in a fleshy pulp then it is a berry. So a tomato is a berry and a fruit, and a banana is also a berry.

A strawberry is a fruit, but it is not a berry.

A vegetable is defined as a plant, or part of a plant, eaten as food.

Fruit is a botanical term, while vegetable is a culinary term. A fruit is the ripened ovary of a seeded, flowering plant. A vegetable is a plant that is grown for its edible parts. Therefore, fruits can technically be vegetables. In cooking, the word fruit is usually used to describe a more sweet plant (those with higher fructose content.) While fruits with lower fructose content are referred to as vegetables (tomato, cucumber, bell pepper, pumpkin and squash are examples.)

The debate over whether a tomato was a fruit or a vegetable was actually ruled on by the United States Supreme Court in 1883. In the case of Nix versus Hedden Their ruling was that a tomato is a vegetable.

A fruit has seeds in it. A vegetable does not. So it brings up the tomato Question about whether it is a fruit or vegestable and it is a fruit because it has seeds.
