The only time it is acceptable to turn left at a red light is if the perpendicular street on which you would be turning is a one way and in turning you would be going the correct direction. If it was an open intersection, the driver turning left is at fault. If there is a traffic signal, stop sign or one way street involved, it could be either driver, depending on circumstances.
