1st degree murder - premeditated and done w/ malice

2nd degree murder - malice, but not premeditated

Felony murder - killing that takes place during commission of another felony (regardless of malice!)

Voluntary manslaughter - would be murder, but victim did something to killer that would cause a reasonable person to lose self-control (words alone never enough aka. just making fun some of someone) (can't be a "cooling down" period)

Involuntary manslaughter - no intent to kill, but death is result of conduct so reckless that it causes extreme danger or injury

Negligent homicide - failed to exercise reasonable amount of care, and someone died because of it

Punishments vary from state to state.

Cold Blooded Homicide--- Not planned out just done out of a motive (usually) (F1)

Premediated Homicide is one... Premeditated means it was planned out... (F2)

Negligent Homicide-- Can be an innocent bystandard of a crime, usually punishable also by F1 and F2 charges... -- But can also be charged as an (F3) Because it was so negligent and not planned out... and it just "happened" usually ...Done out of carelessness and charged to show carelessness...

MURDER: murder is usually the most purposeful act of homicide: it can be premeditated or impulsive but still planned in some way, even if the plan is only for a second.

MANSLAUGHTER: manslaughter is the killing of a person that normally is the result of another crime. One exception to this rule is the commission of a violent crime, such as armed robbery, in which a person is killed: this would be called felony murder. You can be charged with felony murder even if the victim was not your intended target.

The other crime that is associated with manslaughter is usually some type of fighting in which a homicide results. There is involuntary manslaughter, where the perpetrator commits a violent act and kills the victim by accident. Then there's voluntary manslaughter, which is more serious, but involves a situation where the victim provokes the perpetrator.

Other types of manslaughter that someone can be charged with is vehicular homicide, DUI manslaughter, and homicide by culpable negligence. homicide by culpable negligence is the act of causing someone's death as a result of the negligent act committed by the perpetrator.
