no, well typically not, usually if the smoker lives in the home with the child the mother will have to make arrangements with cps to have that person removed from home. CPS Agents believe themselves to be God and think that their authority can trump all others. But they are not, and they are supposed to comply with court orders.

you can legally move as long as you are not in the court system. I've been through this. i would recomend not even notifying them of your move,as in my experience they love to twist your words and lie. cps!! there job is to make you look like a bad parent so they can make there money. It's your call but when i moved i wanted to start fresh. every parent has diffrent ways they do things. they want it done only there way and if you dont they can turn your life into a living hell. And most of them dont even have kids of there own so how can they hand out advice good luck to you and your family!!!
