If this matter is currently in litigation, you (or your attorney) could ask the judge to hold the company in civil contempt. If it can be proven that it was destroyed in anticipation of its being introduced into evidence, this fact could be brought out by your attorney and the jury would probably give it whatever weight it deserved in their deliberations.

Can i sue a person 9 years after car accident?

No. There is no statute of limitations in any state that would permit you to sue someone 9 years after the accident. There is a policy rationale for this based on the fact that all of the witnesses and evidence will be difficult or impossible to find after such an extensive period of time. Most state statutes of limitation are 2-4 years for auto accidents.
