The only Union states that WERE invaded by Confederate military forces were Pennsylvania and Maryland.

He didn't. He resigned his commission as a colonel in the United States army and offered his service to the Virginia State Forces. He worked as a Military advisor and commanded a small army in modern-day West Virginia.
