If you do not know where he is you can put an ad in the local paper for

30 days if he does not respond then the divorce will be granted

Additional: While the above statement is factual in description, you must check with your local court system, or your attorney. There are certain legal requirements that must be met to notify an absent or missing spouse, and they must be be met before the decree can be issued.

Your spouse is entitled to be notified of your complaint for divorce. If your spouse cannot be found in order to serve her/him with the complaint personally the judge will allow publication to serve as legal notice.

You need to visit the court in your jurisdiction for instructions.

Only if you obtained the divorce legally by following all the requirements of notice to the other party. My husband and I live separately. Can I file a petition for divorce by myself?

United StatesYou can petition for divorce but you cannot do it in secret. The court will order that your husband be served with the notice of your filing. If he cannot be found the notice will need to be published in a local newspaper. If he doesn't respond the divorce can proceed. A person who refuses to respond to or sign divorce papers cannot prevent the other party from obtaining the divorce.

Can you put an add in the newspaper for a divorce?

When all other methods fail, the court will allow service to be made by publication. This involves announcing the divorce petition in a newspaper where your spouse is likely to be living for a specified amount of time. You will need to return a copy of the newspaper notice, with a statement for how long the notice ran, to the court for proof of service.

What paper do you need so you can file a notice of divorce in the paper?

The notice of divorce comes after you have been before the judge. Once you have that, you can ask the Clerk of Court for an example, or form. They usually have one. Or you can ask the clerk at the newspaper where you want to file a notice. Check the local county or state web sites for forms you will need. They also may have requirement of where you need to post your notice. Some sham of a newsletter may not qualify. They may require certain papers to be of broad enough distribution that the notice would be valid.

What if the spouse does not accept the divorce notice?

If the server can not deliver the documents for some reason, the notice can be printed in your local newspaper. That makes it public and the spouse is considered "served". From then on - you don't need him if he won't cooperate. You can still get the divorce. Your attorney should be able to explain it all to you. If you are being hassled by spouse over this, get a protection order. If you are trying to do a "do it yourself" divorce...you, as they say "have a fool for a client, and you need to hire an attorney right away.

What form is used to cancel a divorce filing?

Can a spouse get a divorce in Minnesota without your consent?

Yes. Both parties do not need to consent to a divorce. With the advent of "no-fault" divorce laws in the 70's and 80's, most states only require that one party show that the marriage is "irretrievably broken" or something similar. A court would very rarely refuse to grant a divorce if one party wants one, even if the other party feels that they can work it out. However, he must serve you with proper notice and give you the opportunity to be heard in court.

Can your spouse divorce you without you knowing about it in Texas?

Yes. Here's the scenario. You and your spouse separate and fall out of touch with each other. Your spouse, for whatever reason, decides it's time to divorce you but doesn't know how to reach you. Your spouse can file for divorce in Alabama (and most other states for that matter) and seek the court's permission to serve you by publication, the running of an advertisement about the divorce filing that runs for four consecutive weeks in a local newspaper. And this is often a newspaper that no one but lawyers reads. At the end of the four weeks, you are deemed to have been served with legal process about the divorce case, even though everyone knows there's little or no chance you actually would have read that notice. 30 days after that, your spouse can file an application with the clerk to have you declared in default, clearing the way for your spouse to give oral testimony in court and obtain a divorce.

what happens if I do not have an address to notify my partner of my intent to divorce?

You'll need to file a 'Petition for Divorce, Summons with or without Children, Spouse's Location Unknown.' What happens is that the notice of the divorce petition will appear in a local publication acceptable to the court. That will be sufficient notice for the courts to proceed.
