There is no law saying you have to give your new employers information on a failed drug test. You sign a waiver form and give the lab permission to give your employer the results.

Answer To my knowledge, in America, no, not unless someone from the old job tells the new employer, but if they do it is against the law to give out that information and they could get into trouble and most people wouldn't jeopardize their job for that bit of information. When someone calls a past employer, all that is supposed to be given out is the length of time you worked there and possibly your title. I don't think you have anything to worry about. Actually you must answer if they failed a drug test, if they are DOT. Meaning that they hold a CDL and they drive a vehicle for their job. Then by law, you are obligated to answer truthfully. And if you don't, you could be sued.
