In order for a non-custodial parent to claim a child as a dependent he has to meet some pretty stringent guidelines that basically amount to either getting your explicit permission on a specific IRS form that says he can do so (and that you're not going to for that year), or having it in the divorce decree that you will not claim the child and that he is allowed to do so (depending on exactly when you got divorced, he may still have to have you sign the form even if the divorce decree says so).

So, if you know he's done this without your permission and there's nothing in the divorce decree about it, you CAN report him to the IRS. They tend to take a rather dim view of this sort of thing.
