Contact both companies and the original creditor at the same time with the same letter, making sure that each one sees that you are witing to the other. Ask each company for proof of its right to collect the debt. Ask the creditor to confirm which company it authorized to collect the debt. There will have to be some written authoriztion in the form of a power of attorney or document showing that the debt has been assigned to the company for collection. Demand that they a reply within 30 days or you will file a lawsuit against the creditor and one of the collection companies unless your money is returned to you within that 30 days. Someone messed up. Either the creditor authorized two companies to collect the same debt, or one of the companies did so without proper authorization. Be sure to tell them that you will be invoking the Federal Fair Debt Collection Practices Act and any similar state act, if there is any, seeking extra damages, costs and counsel fee.s
