The state and/or the specific statute is not given, however it sounds like a motion was presented to the court requesting an extension of time regarding the discovery aspect of the trial, and they are apparently quoting the appropriate portion of the state statute or court rules that allows it to be granted.

If you mean, can they be included in a chapter 13, the answer is, they must be. If you mean, can you file a chapter 13 because of garnishments and secured loan payment arrears, yes, that's what chapter 13 is for.

Best chance: Make sure your 401k plan administrator files a claim as a secured creditor, which you of course won't protest.

How long do you have to wait IF you discgarge ch 7 before you file ch13?

As of October 17, 2005, the new time limit for filing a Chapter 7 is now eight (8) years from the discharge date of a previous "7" filing. The time limit for a Chapter 13 is four (4) years from the discharge date of a previous "7" and two(2) years from the discharge date of a previous "13".

We R 180 days behind on all of our debts we have to wait 1 year and 7 months before filing ch 7 dont want to do ch13 what will the creditors do if we wait that long garnish wages court sue etc?

Each creditor will act differently...but all the things you mentioned are possible. And more. Don't want C-13 because you may actually have to pay off some of what you took from others? Of course, you seem to be pretty well experienced in handling angry creditors...and finding ways not to pay - rather than ways to pay off a few months back over some period of the future. Oh well. I gues no need to tell you how dishonorable that is...or that you actually don't have any right to do it.

Should items included in and discharged from ch13 bankruptcy still be on credit report after 7 years has passed?

The Fair Credit Reporting Act allows information on accounts (what you referred to as "items") to remain for 7 years plus 180 days from the last time the account was paid on time immediately preceding the collection, charge off, or bankruptcy (whichever applies). So, in general, the answer to your question is no. However, this provision only applies to debts that originated after to Dec. 1997. It is possible that older debts can still legally show. The Fair Credit Reporting Act is also superceded by any applicable state's laws, or any other overriding statute of limitations. (For instance, unpaid tax liens, child support and student loans are often exempt from the time limits and can haunt a consumer forever). The information about the legal action of bankruptcy (the court case) may show for longer than 7 years, in the public record portion of the credit report. Chapter 7 bankruptcies show for 10 years from the date of discharge. Chapter 13 may show this long, although it is typical for the legal entry to "fall off" after seven years. If you feel that there is obsolete information on your credit report, write a letter of dispute to any bureau showing these items requesting clarification on their age and request their removal.

What was tariff of abomination?

The Tricky "Tariff of Abominations" In 1824, Congress increased the general tariff significantly. The Tariff of 1828- called the "Black Tariff" or the "Tariff of Abominations"; also called the "Yankee Tariff". It was hated by Southerners because it was an extremely high tariff and they felt it discriminated against them. The South was having economic struggles and the tariff was a scapegoat. The South Carolina Exposition, made by John C. Calhoun, was published in 1828. It was a pamphlet that denounced the Tariff of 1828 as unjust and unconstitutional. "Nullies" in the South In an attempt to meet the South's demands, Congress passed the Tariff of 1832, a slightly lower tariff compared to the Tariff of 1828. It fell short of the South's demands. The state legislature of South Carolina called for the Columbia Convention. The delegates of the convention called for the tariff to be void within South Carolina. The convention threatened to take South Carolina out of the Union if the government attempted to collect the customs duties by force. Henry Clay introduced the Tariff of 1833. It called for the gradual reduction of the Tariff of 1832 by about 10% over 8 years. By 1842, the rates would be back at the level of 1816. The compromise Tariff of 1833ended the dispute over the Tariff of 1832 between the South and the White House. The compromise was supported by South Carolina but not much by the other states of the South. http://www.apnotes.net/ch13.html
