Henry married his brother's wife Catherine of Aragon and at the time was given permission to do it. They had barely been married when Albert died. Years later when Henry wanted a divorce from Catherine he used an argument that the marriage was invalid because she had been the wife of his brother. He wanted a male heir and at 40 Catherine couldn't give him that. He worried that without a son the throne could be challenged by the York factions. His father had won the crown from York and his mother was Elizabeth of York so the hold on the throne by the Tutor was not very strong. His mother's brother should have been king. He needed a divorce so he could remarry and try to have a son.
