Well lets give an example of that: Great Britain. What Guarantees that that King or Queen isn't above the law? First, the last King to succeed in that, Charles I, was beheaded. Second, During the English Civil-War of the mid 1600's, of which Charles's death is a part, A dictator named Oliver Cromwell, who had been the head of parliament, ruled with an iron fist, so much so that it was decided that a parliament with a constitutional monarchy was necessary, and he was overthrown after a long and bloody war. The next few Kings had learned from Charles and never repeated his offenses again, even if they wanted to.

Finally, the Catholic Monarchy was overthrown, and a German, Protestant family was invited to rule, William and Mary of Orange. Protestants of course were more liberal in the Constitutional sense in that period, and so ever since then Parliament has reigned supreme.

Another example is George Washington. His army officers wanted to install him as King of America, but he refused. When it came time to elect a new President, after the Constitution was ratified, Washington was trusted with the office, not only because of his refusal of the crown, but because he was childless, and so that is why there is no King in America.

So to summarize, Kings are not above the law because since the English Civil-War, any King or Queen that tries to rule above the law dies...quickly!
